1. Introduction

ListingLedge is operated by RMLS, LLC, a South Carolina limited liability company ("ListingLedge", "we", "us", "our"), which provides the website listingledge.com and the ListingLedge platform (collectively, the "Platform"). This Privacy Policy describes how we collect, use, disclose, and protect personal information when you use our Platform.

By accessing or using the Platform, you acknowledge that you have read and understand this Privacy Policy. 2. Information We Collect

We collect the following categories of information:

Account Information

When you register, we collect your name, email address, and profile photo. If you register via Google or Facebook OAuth, we receive the information you authorize those services to share. If you register via email, we store your email and hashed password.

Listing Content

Everything you enter in Listing forms — including business descriptions, photos, financial summaries, pricing, and availability — is stored by us and, depending on the Listing type, displayed to other members.

Usage Data

We collect information about how you interact with the Platform, including pages viewed, search queries made, Listings saved, and features used.

Communications

Messages sent through the Platform between members, inquiry forms, and support communications are stored by us.

Device and Technical Information

We automatically collect technical information including browser type and version, operating system, IP address, referring URLs, and cookie identifiers.

3. How We Use Your Information

We use the information we collect to:

• Provide, operate, and maintain the Platform and all its features.
• Process transactions and bookings.
• Send transactional email notifications, including Listing inquiries, Confidentiality Agreement requests and confirmations, and booking confirmations.
• Send marketing emails, newsletters, and Platform updates. You may opt out at any time via the unsubscribe link in any marketing email.
• Improve, personalize, and expand the Platform based on usage patterns.
• Detect, prevent, and respond to fraud, abuse, and security incidents.
• Comply with applicable legal obligations, respond to legal process, and enforce our Terms of Service.

5. Data Sharing

We share personal information only in the following circumstances:

Service Providers

We use trusted third-party service providers to operate the Platform, including: Supabase (database and authentication), Vercel (web hosting and infrastructure), Stripe (payment processing), Resend (transactional email), and Sentry (error tracking and monitoring). These providers access your data only as necessary to provide their services and are contractually bound to protect it.

AI Service Providers

When you use our optional AI features (such as AI-generated listing descriptions, valuation estimates, and concept renderings), the content you submit to those features is processed by third-party AI providers, including Anthropic and OpenAI, solely to generate the requested output. Do not submit information to AI features that you do not wish to be processed by these providers.

Advertising & Analytics Partners

We use Google (Google Analytics and Google Ads) to understand Platform usage and to measure our advertising. As described in the Cookies section, this may involve sharing online identifiers with Google for analytics and ad measurement. This activity is subject to your cookie-banner choices and applicable opt-out rights.

Other Members

Your public Listing information and profile details are visible to other registered members. Information submitted in inquiries or through CAs is shared with the applicable Listing owner.

Legal Disclosures

We may disclose your information when required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect the rights or safety of ListingLedge, our members, or the public.

We do not sell your personal information for money. We share personal information only as described in this policy, and you can opt out of sharing for cross-context behavioral advertising through our cookie consent banner (see Your Rights).

6. Data Retention

We retain your personal information for as long as your account is active and as necessary to provide you with Platform services.

If you delete your account, we will retain your data for a period of 90 days to allow for account recovery, after which your personal information will be permanently deleted from our systems, except where we are required to retain it for legal or compliance purposes (such as transaction records or legal hold obligations).

7. Your Rights

You have the following rights with respect to your personal information:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request that we correct inaccurate or incomplete data.
• Deletion: Request deletion of your personal data (subject to legal retention requirements).
• Export / Portability: Request your data in a portable format.
• Marketing opt-out: Unsubscribe from marketing emails at any time via the link in any email or by contacting us.

California residents: You have additional rights under the California Consumer Privacy Act, as amended by the CPRA, including the right to know what personal information is collected, the right to delete and to correct it, the right to opt out of the sale or sharingof personal information, and the right to non-discrimination for exercising your rights. We do not sell your personal information for money. We do use advertising and analytics technologies that may be considered "sharing" for cross-context behavioral advertising — you can opt out at any time using our cookie consent banner or by sending a Global Privacy Control (GPC) signal, which we honor where required.

EU and UK residents: You have rights under the General Data Protection Regulation (GDPR) and UK GDPR, including the right to object to processing, the right to restriction, and the right to lodge a complaint with your local supervisory authority.

8. Children's Privacy

The Platform is not intended for or directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected personal information from a person under 18 without parental consent, we will take steps to delete that information promptly. 9. Security

Where your data is processed. ListingLedge is based in the United States, and the information we collect is processed and stored in the United States and in other countries where our service providers operate. If you access the Platform from outside the United States, you understand and agree that your information will be transferred to, stored, and processed in the United States, where data-protection laws may differ from those in your country.

We implement industry-standard security measures to protect your personal information, including encryption of data in transit (TLS), access controls that limit data access to authorized personnel only, and ongoing security monitoring and periodic review.

While we take reasonable steps to protect your information, no system is 100% secure, and we cannot guarantee the absolute security of your data. In the event of a data breach affecting your personal information, we will notify affected users and applicable authorities as required by law.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify registered members via email and post a prominent notice on the Platform. The updated policy will be effective as of the "Last updated" date at the top of this page. We encourage you to review this policy periodically.
